      • This Week: Links to events set up on Facebook. This requires an ongoing task of setting up events on Facebook and adding links to the website.
      • Next Week: Similar to “This Week,” requires setting up Facebook events and adding links to the website.
      • Upcoming: Similar to “Next Week,” requires setting up Facebook events and adding links to the website.
      • Producers: Links to the Instagram accounts of producers.
      • Comedians: Links to each comedian’s website.

Payment Terms:

50% of total is due at signing
25% 3060 days after project start date.
25% of the total is due when the project is completed or 60 days after project start date (whichever comes first).
Monthly services - such as hosting and SEO - require a credit card on file.
Project restart fee - If there is no response or communication from you on your project or if we do not receive required material after multiple attempts, after 30 days your project is forfeited and if you choose there is a restart fee of $250.

Requirements:

Project Timeframe:

Design mock-ups will be created and presented to the client within three weeks upon acceptance of this Estimate, receipt of 50% deposit and completed design questionnaire. Website programming will be completed within 3 month (unless noted otherwise within project details) after design mock-ups have been approved and after the client had provided all website content.

Terms & Conditions:

The above-named client (referred to herein as “client”) has engaged Webene, LLC (hereinafter “Webene”) for the project detailed in the “Description” section of this estimate.

1. SERVICES RENDERED. Webene agrees to perform the project detailed in the “Description” section of this agreement. All services described herein are to be performed by Webene &/or its contractors in accordance with the most commonly accepted standards and practices of the Web Services Industry. That is to say, Webene will use web site design technologies that are most universally acceptable in order to satisfy the broadest web market possible.

2. COST. Notwithstanding any prices listed in literature or on Web pages, the client and Webene agree that the services described in this contract shall be completed for the amount shown under Project Total.

3. ADDITIONAL SERVICES. The terms and conditions set forth in this document constitute the sole agreement between Webene and the client regarding this project. Any additional work not specified in this contract must be authorized in writing. Should the client desire additional services beyond the original “Description”; the client agrees to pay WEBENE an additional $150 per hour.

4. SUBCONTRACTING. Webene reserves the right to assign other Web designers or subcontractors to this project.

5. WARRANTIES AND LIABILITY. Webene does not warrant that the functions of the website will meet the client’s expectations of site traffic or resulting business. In no event will Webene or its sub-contractors be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these Web pages or Web site, even if Webene has been advised of the possibility of such damages.

6. TRADEMARKS & COPYRIGHTS. The client represents to Webene and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Webene for inclusion in any work are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Webene from any claim or suit arising from the use of such elements furnished by the client. Copyright to the assembled work of Web pages produced by Webene is owned by Webene. Upon final payment of this contract, all rights owned by Webene as to the design, graphics, and text in this Web site transfer to the client. Webene owns the copyright for this document and all its contents. This proposal should be considered private and confidential and may not be shared with any third party without the prior written permission of Webene.

7. DESIGN CREDIT. Client agrees that Webene may put a byline on the bottom of their website establishing design and development credit with an active text HTML hyperlink to Webene’s website. The Client also agrees that the website and/or any work may be included in Webene’s portfolio.

8. LITIGATION. Any disputes arising from this contract will be arbitrated in San Diego County, California. The Client shall pay all arbitration and court costs, reasonable attorney’s fees, and legal interests on any award of judgment in favor of Webene. This Agreement shall be governed and construed in accordance with the laws of the State of California, USA.

9. REFUND POLICY. The Client may halt work and request for a refund within 3 business days of the date of this contract by mailing a certified letter to Webene headquarters. A service fee, 15% of the project will be charged for refund if a project is canceled after the beginning of the project. If at any time of the request for a refund, work has been completed beyond the amount covered by the initial payment, Client shall be liable to pay for all work completed at the hourly rate of $150, which could result in higher fees than the quote prices given.

Undersigned hereby agree to the terms, conditions, and stipulations of this agreement on behalf of his or her organization or business. This Agreement constitutes the entire understanding of the parties. Any changes or modifications thereto must be in writing and signed by both parties.
